The CLARITY Act cleared the Senate Banking Committee with a 15 to 9 bipartisan vote on May 14, 2026. The tally saw 13 Republicans join Democrats Ruben Gallego (AZ) and Angela Alsobrooks (MD) in favor. This marks the bill’s most consequential legislative step since the House passed its version by 294 to 134 in July 2025

Committee Dynamics

Chairman Tim Scott used a procedural maneuver to admit late amendments, securing the two Democratic votes. Alsobrooks warned: “My vote today is a vote to keep working in good faith – we still have so much work to do.” Gallego added he is “not afraid to vote no” on the Senate floor if an ethics deal remains unresolved.

Legislative Hurdles: Ethics, Filibuster, and Reconciliation

Despite the committee win, analysts highlight three critical obstacles before the bill reaches President Trump’s desk:

  • Ethics Provision: The current text lacks conflict-of-interest rules on government officials profiting from crypto. Senator Kirsten Gillibrand insists the bill will not pass the full Senate without such language. The White House opposes wording that singles out any specific officeholder.
  • 60-Vote Threshold: The full Senate needs 60 votes to overcome a filibuster. Republicans, with 53 seats, require at least 7 Democratic votes. Mark-ups have exposed deep partisan divides.
  • Reconciliation with the House: The Senate version passed as a 309-page draft on May 12 that resolved the stablecoin yield dispute by banning passive interest while allowing activity-based rewards. The bill must still be merged with the House’s July 2025 version before final passage.

Market Implications

Stablecoin yields – a $200B+ market across USDT, USDC, and DAI – would be directly impacted by the passive interest ban. Protocols like Aave and Compound could see lower total value locked (TVL) if passive rewards are capped. Meanwhile, optimism for a clear regulatory framework has historically fueled BTC and ETH inflows; any further delay may reinforce risk-off sentiment in crypto markets.

Investor Takeaways: Probability Below 50%

GSR’s Chief Legal Officer Joshua Riezman set the odds of enactment this session at below 50%. TD Cowen remains pessimistic, noting Democrats will likely demand a vote on a conflict-of-interest amendment targeting President Trump’s crypto ties – a vote Republicans want to avoid near elections.

Senator Cynthia Lummis warned that missing the August recess window could push comprehensive crypto legislation off the calendar until 2030. The clock is tight: the House version passed 10 months ago and has stalled repeatedly since January 2026 over the same fault lines.

Market Outlook

Neutral-Bearish in the short term. Regulatory clarity remains a key catalyst for institutional adoption. Without the CLARITY Act, stablecoin issuers and DeFi projects face continued uncertainty. Traders should watch the Senate floor vote count and any ethics amendment proposals closely.
